Civil Process/Transport
The sheriff has a statutory responsibility for serving
civil process papers and the transportation of prisoners to the
Dodge County Circuit Court. To accomplish these tasks, the sheriff's
department has the Civil Process/Transport Division. This division
consists of three deputies.
One deputy's primary responsibility is the service of
civil process papers. Thousands of civil process papers are served
annually.
Two deputies are assigned to the Transport Division.
These two deputies travel throughout the state of Wisconsin and
beyond transporting prisoners to the Dodge County Circuit Courts.
Transports are also done with subjects who are involved in emergency
detentions where they are transported between hospitals and court
proceedings.
Fees are waived only when papers for service are accompanied with
signed court ordered waiver of fees or indigence. Fees are due and
payable within thirty days of service or pre-payment may be required
of the plaintiff for future service.
Dodge County Sheriff's Department is responsible for any prison
service for the four state correctional facilities that lie within
Dodge County, that being Waupun Correctional, Dodge Correctional,
John Burke Correctional in Waupun and Fox Lake Correctional in Fox
Lake.
Typically papers are served within 48 hours of the receipt by the
sheriff. Any additional information reference phone numbers,
workplace and hours, vehicle, date of birth or physical descriptors
included with the papers for service saves excessive fees and
officer's time. One complete copy is needed for service upon the
person or company and one cover sheet of the document is needed. If
the sheriff has to make a copy of the cover sheet for the
certificate, there is an additional $1 copy charge.
If after three attempts service is unsuccessful, contact will be
made with the plaintiff for further instructions. Otherwise attempts
will be made until such a time as the serving deputy deems it is
futile to continue or plaintiff indicates in a cover letter the
maximum attempts to be made.
Small claims summons require 8 business days prior to court date
for adequate service or 5 business days prior to court for eviction
summons and complaints.
All court orders for appearance require 24 hours prior notice
except for family court matters which require 5 business days prior
to court or unless otherwise specified in a cover letter.
Subpoenas may be served until the time of court however this
department tries to serve by 24 hours prior to court.
Restraining orders typically need to be served 48 hours prior to
court unless otherwise indicated.
Large claims summons and complaints need service within 60 days
after signing by the court.
Notices drafted by plaintiff but not filed as a legal court
document such as first stage eviction notice or notice of worthless
check etc..., may be posted on residence door and do not need
sheriff department service, unless the plaintiff prefers official
documentation of service by a police official.
Sheriff sale notices need to be re-posted if adjourned for more
than 24 hours from original date. $75 will incur for new posting
fees. All sheriff sales are held in the lobby of the sheriff's
department, 124 West St., Juneau, WI 53039.
